Currently Mr. Prakash Almeida, the Founder and Director of CongiLingua is leading a critical study on cogni-lingual analysis of great legal cases argued by great legal luminaries like Nani Palkhivala and others. This is a huge independent project in applied cognitive linguistics inspired by the linguistic genius of great lawyers, especially of Nani Palkhivala.
A team of linguistics who study language scientifically in its varied contexts has undertaken a study and research project to study legal linguistics.
This research study in legal linguistics aims to make a substantial contribution to serve the law in prevailing and emerging evolving contexts. Law does not exist in isolation or in vacuum as it is a dynamic interplay of various disciplines.
Legal linguistics is the study of how language is used in the legal system, including in trials, judicial procedures, and crime investigations. Experts agree that legal language is emerging as a genre in itself. Its use in playing various roles such as pleading, arguing, claiming, and so on. It is now a ‘technolect’. The legal communication when seen from the prism of linguistics brings forth finer nuances of the legal language.
Better sense of the law could be made through the tools of linguistics. Use of legal language is notable for the fact that it is very widespread: it governs all areas of social life, and it can, through intertextuality, be combined with language from any and every domain. Furthermore, legal language is very old, which is not necessarily the case with most other languages for special purposes. This is why, historically, it has shaped the ordinary language of various countries, and in a significant way. Even today, legal language still influences ordinary language. The present evolutionary state of the legal language in India, how the authority of the law is strengthened by legal language, the impacts of technologies such as IT and now AI are critical areas. Legal language as an instrument of social management and control needs to be explored, studied and researched in India.
In law, every event is a language event. Law is essentially language and hence linguistic in its constitution and form. As a cognitive activity law hinges primarily on cognitive linguistics. Today advances in neuroscience research that has increased our knowledge of how our brain works has an impact on law and its work. Law is cognition in action and hence how our brains process language is of critical interest and relevance to the field of law. Law is more inter and multidisciplinary than ever before. Consciousness about language and law constitutes core area of legal linguistics.
Lawyers’ expertise is primarily the law, not linguistics. They cannot be expected to understand all the phonological, morphological, syntactic, semantic, pragmatic, discourse, and lexicographic principles that lead to court battles over language. Nor are they usually trained in these critical tool areas of linguistics.
In important areas, law is deeply linguistic. The linguistics of law can help us understand the language of law in real terms. This study focuses on linguistic discourse and rhetoric.
The philosophy of language played a foundational role in his theory of law and hence it is also a part of this study. Law is also communication and applied linguistics.
Note that this is not any academic study for mere scholarship but to harvest actionable knowledge, vital insights and develop a better perspectives and resourcefulness of professional work.
